Support
Withholding
The custodial parent can
request the court to order immediate automatic withholding,
even if the support payments are not past due. All support
orders issued since January 1, 1994, require immediate
withholding unless specifically waived by court order or by
the written consent of both parents. Since the passage of
the Welfare Reform Reconciliation Act of 1996, all orders
that are in arrears will cause immediate withholding.
Limits
The order will state the amount to be
deducted for child support. The maximum amount of an
employee's compensation that is subject to attachment for
child support is governed by the Consumer Credit Protection
Act (CCPA). The maximum percentage is based on an employee's
disposable earnings (gross
earnings less federal/state/local taxes).
